EazyCrate Crates Rental Agreement

Welcome to EazyCrate! This Crates Rental Agreement (“Agreement”) is made and entered into by and between EazyCrate (“Company”, “we”, “us”, or “our”) and the user (“Renter”, “you”, or “your”), collectively referred to as the “Parties”. This Agreement sets forth the terms and conditions under which you agree to rent plastic moving crates and related equipment (“Crates”) from EazyCrate. By renting Crates from us, you agree to be bound by the terms of this Agreement.

Rental Period

1. Commencement: The rental period shall commence on the date the Renter receives the rented crates and shall continue until the return of the crates to EazyCrate.
2. Rental Duration: The standard rental period for crates is 2 weeks (14 days), unless a different duration is agreed upon in writing or booked in the online reservation system at the time of rental.
3. Extension of Rental Period: If the Renter wishes to extend the rental period, they must notify EazyCrate at least 48 hours before the end of the current rental period. Extensions are subject to availability. Additional charges will apply on a pro-rata basis.
4. Late Returns: Crates not returned by the agreed date without a confirmed extension may incur late fees as specified at the time of rental.
5. Early Returns: There shall be no refund of the rental fee for unused portions of the rental period.
6. Condition Upon Return: The Renter agrees to return the crates in the same condition as received, normal wear and tear excepted.
7. Return Procedure: Instructions for returning the crates will be provided by EazyCrate at the time of rental.

Warranty

1. Condition of Crates: EazyCrate warrants that the Crates will be in good working condition at the time of delivery.
2. Limited Warranty: This warranty is limited to the condition of the Crates upon delivery. EazyCrate does not provide additional warranties, express or implied.
3. Renter’s Inspection: Upon receipt, the Renter agrees to inspect the Crates and notify EazyCrate immediately of any defects. Failure to notify will be deemed acceptance in delivered condition.
4. No Modifications: The Renter agrees not to alter, modify, or tamper with the Crates in any way.
5. Warranty Exclusions: This warranty does not cover damages from misuse, abuse, accidents, alterations, negligence, or improper handling.
6. Remedies: In the event of a breach of this warranty, EazyCrate’s sole responsibility will be the replacement of the defective Crates, subject to availability.

Liability

1. Renter’s Liability: The Renter shall be fully responsible for the Crates upon delivery and until returned and accepted by EazyCrate. The Renter agrees to pay the full replacement cost ($35 per crate) for any Crates that are lost, stolen, damaged, or destroyed, excluding normal wear and tear.
2. Limitation of EazyCrate’s Liability: EazyCrate shall not be liable for any indirect, incidental, special, consequential, or punitive damages related to the rental of the Crates.
3. Indemnification: The Renter agrees to indemnify and hold harmless EazyCrate from any claims, damages, liabilities, costs, and expenses arising from the Renter’s use, handling, transportation, or return of the Crates.
4. Force Majeure: EazyCrate shall not be liable for failure or delay in delivery arising from events beyond our reasonable control.

Payment & Charges

1. Rental Charges: The Renter agrees to pay rental charges as specified at the time of the agreement, based on the rental period, number of crates, and additional services.
2. Payment Terms: Payment is due upon the Renter’s receipt of the Crates. EazyCrate accepts all major credit cards. Payment must be made in full, including applicable taxes and fees.
3. Late Fees: If Crates are not returned by the end of the rental period, late fees will apply. Daily rates: Crate $0.50/day, Hand Truck $5/day, Dolly $2/day, Wardrobe Box $2/day.
4. Damage or Loss Charges: The Renter is responsible for any damage or loss during the rental period. Repair or replacement charges will be assessed based on the extent of damage or replacement value.
5. Rescheduling Fee: Rescheduling delivery or pickup within 24 hours of the agreed time will incur a fee of $25.
6. Cleaning Fee: Crates returned in an unusually dirty condition will incur a cleaning fee of $2.50 per unit.
7. Security Deposit: The Renter agrees that their credit card information will be kept on file for the duration of the rental.

Title

1. Ownership: All Crates and equipment remain the property of EazyCrate at all times. The Renter is authorized to use the equipment solely for the duration and purpose of the rental.
2. No Transfer of Title: The Renter shall not sell, transfer, pledge, sublease, assign, or lend the Crates to another party.
3. Protection of Rights: The Renter agrees to keep the Crates free from any liens, attachments, or encumbrances and shall not remove or alter any identification or markings placed on the Crates.

Governing Law

1. Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
2. Agreement to Arbitrate: Any dispute arising out of or relating to this Agreement shall be determined by arbitration in New York State before one arbitrator, administered by the American Arbitration Association.
3. Compliance: The Renter agrees to comply with all applicable federal, state, and local laws while using the rented Crates.
